tHIS IS FROM MY vIRGINIA SENATOR JOHN WARNER (post #7)
I WROTE AN E-MAIL ABOUT THE FCC TO JOHN WARNER AND HE SENT AND E-MAIL TO ME SAYING THAT HE HAS NOTHING TO DO WITH WHAT THE FCC DOES. THEN I CHECKED HIS WEB SITE AND HE CREATED A BILL STREAMLING THE NEW FINE PROCESS ALLOWING THE FCC TO FINE WITHOUT GIVE A WARNING.

For Release: March 11, 2004

WASHINGTON, DC - U.S. Senator George Allen (R-VA) along with Senator Ted Stevens (R-AK) announced the inclusion of their amendment to the Broadcast Decency Enforcement Act of 2004, which passed Tuesday in the Commerce Committee and will now move to the full Senate for debate.

"Our amendment brings a greater degree of culpability and responsibility to performers for uttering or performing indecent material on national, live broadcasts, which would otherwise be out of the control of the network and/or other broadcasters. For example, the performers at the Super Bowl halftime show would be subjected to a fine for willfully and intentionally performing an indecent act," Allen stated.

Currently the Federal Communications Commission (FCC) has the authority to hold non-licensees, such as performers appearing on a show responsible for decency violations, but the existing statute requires a two-step process. First, the FCC must issue a warning for the first offense, and then a subsequent and similar violation must occur in order for the FCC to impose a fine.

"Our amendment would streamline the process for the FCC, allowing fines to be imposed on those committing the violations on the first offense in which they acted willfully and intentionally," Allen concluded.
