As much as I like Hootie, he's going to lose quite a bit here no matter what. He has the best defense lawyers in our area working on it, but he's probably going to spend $2-5M defending this case if it goes all the way to trial anyway. My guess is that they'll be a settlement at some point with the Hogans paying the Grazianos about $10-5 M, but Hootie will probably have to spend several million bucks and a lot of heartache to get there.

The days of letting your kid screw around in a car or with beer (like so many have done before us) is over. These days, if someone gets hurt, whether it's your best friend or not, there's gonna be a lawsuit.

Yeah, as much as I love me some Hulkamania, I really don't think Hulkster has a leg to stand on getting out of this.

Even if he had nothing to do with Nick possibly boozin' it up before the accident, I'm pretty sure the car is actually in his name (don't quote me on that). And also since Nick is a minor, any lawsuit would fall in the hands of the parents. Hopefully that comes out of both parents' halves of what Hulk has earned.

This was no accident,this was just the inevitable sad ending to a series of irresponsible acts.

Give a 17 year old kid (with a history of reckelss driving) some alcohol and a 350 horse power sports car and you'll get the crash scene you have been asking for,not an accident.

State laws vary,but in most states,it is the driver's responsibility as vehicle operator that the passengers are wearing a seatbelt.

I heard an opinion that the divorce is an elaborate work to limit how the proscecution can get from the Hulk since his actions are more direct on this whereas his wife's liability is more theoretical. Any opinions out there on if this is true or urban legend?

There is no way that someone with Hulk's money doesn't have some type of umbrella policy to cover the bulk of what they have to pay, most responsible people do. I'm just an upper-middle guy and I have a million dollar umbrella policy.

Driver gets a ticket too when the passenger doesn't have a seatbelt on. Plus hogan was legally drunk.

You are comparing rear ending someone to a 17 year old kid that his rich parents bought him a super fast street racing car, despite several tickets, and warnings that he regularly drives in excess of 100 MPH that you or your family could be driving down? And why is he driving 100+? Because he wants to race and doesn't care who else he endangers. Nick's parents knew this and depending on the account you believe he encouraged him to street race. If this was a one time deal I might say he was being a stupid teenager, but there is a clear pattern over years.

The passenger has to have some culpability in this incident too though. Undoubtedly he knew that he was going "racing" with Nick and didn't buckle up.

Though I agree that Nick was the dick in this situation and should be held the most responsible. Just that his responsibility isn't 100%.

Well, I read through most of that mess and it looks to me like Hootie is fucked. He knowingly gave beer to his son and his underaged friends the day of the accident. He was with Nick on two occasions that they were clocked at over 100. He had another ticket for over a 100. His mom Linda says she loves street racing. Both cars racing were and are owned by Hootie. Cripes, I feel bad for Hogan and just as bad for the kid who will never be right again. It seems like a lot of evidence against him and his family but that's up to the judge and jury to decide as to what he's liable for financially.

Hey, like I said in my prior post, it sucks for all parties. I undestand Hulk was only trying to be an old-school cool dad. Buying beer and drinking with Nick and his buddies on his boat etc but this kid has had his life taken out from under him. I"m sure if he could talk for himself, he wouldn't want to financially devistate the Hogans and he'd probably admit he had some part in all of it. I'm sure all of the details aren't out but the bottom line is Terry owned both the cars racing, his underage son was racing, a fact known to both his parents and he was underage and tested positive for alcohol. It dosen't look good for the Hogans and this poor kid is never going to live a normal life.

I don't think alcohol played much of a role in the accident. Nick was far under .08. It's a problem legally because Nick is a minor. I think Hogan's major failing was to curb his underage son's propensity to street race. In many homes, a 17 year old boy would have his license taken away by his parents for 6 months for 100 mph speeding ticket. Indeed, Hogan seemed to have encouraged this behavior.

I am sure that both of these insurance together probably will cover up to 5 million of the claim. Hulk should pay up the other 5 million straight from Nicks inheritence and be done with this shit.

In California, driving over 100 is a felony. I know a guy who got caught doing it and he got arrested and lost his license.

In New York anything over 30 MPH over the speed limit and they will take you right to the judge, and take your license on the spot. Had a friend get that in the middle of the night. They woke a judge up and he was not to happy!

Actually they could get off without paying a dime. If there was street racing going on and it is proven to be the mitigating factor, the car insurance more than likely will take a walk. I suspect any settlements and/or awards will be paid out of a Bollea account of some sort.
