Ex-Yankee Leyritz back in jail after bond revoked for alcohol violations

Former Yankee Jim Leyritz is back in jail today after the judge in his DUI manslaughter case revoked his bond because he tested positive for alcohol while driving.
“Right now Jim’s at home, but he may have to turn himself in,” Leyritz’s attorney, David Bogenschutz, told me this morning.

(UPDATE at 1:30 p.m. -- According to a media alert issued by the Broward Sheriff's Office, Leyritz was being booked into the main Broward jail.)

Said State Attorney’s Office spokesman Ron Ishoy: “One of the conditions of his bond was he was not allowed to consume alcohol. Records from the ignition Interlock device on his car indicated that he had consumed alcohol.”

Bogenschutz said Leyritz tested positive for alcohol four times since September, including a Jan. 9 incident while driving.

Leyritz, 45, of Davie, faces a DUI manslaughter charge for a Dec. 28, 2007 wreck in Fort Lauderdale that killed Fredia Veitch.

“I find this shocking that he would even attempt to drive after he has been drinking,” Jack Veitch, Fredia’s father-in-law, wrote to me in an e-mail.

Bogenschutz said there was a misunderstanding over whether the terms of Leyritz’s original bond applied after April 2008, when Leyritz’s case was no longer supervised by the Pre-trial Services division of the Broward Sheriff’s Office.

Bogenschutz has requested an emergency hearing before Broward Circuit Judge Marc Gold to sort out the situation. Gold signed the warrant revoking bond on Thursday.

No word yet if the hearing will be held later today or after the holiday weekend.

Bogenschutz said a pickup order for Leyritz has not been filed with the Clerk of Court or the Sheriff’s Office, but that Leyritz would surrender if it is.

Leyritz is best known for hitting clutch home runs in the World Series and playoffs while a catcher and pinch-hitter for the Yankees, but his personal life has been rocky since he retired from baseball in 2000.

His nadir came in the early morning hours after he celebrated his 44th birthday in December 2007. According to police, Leyritz ran a red light and plowed into Veitch, a mother of two who wasn’t wearing a seatbelt on her way home from her waitress/bartending job.

Toxicology tests showed both Leyritz and Veitch had alcohol in their systems. Blood drawn from Leyritz a few hours after the wreck revealed a blood alcohol level of 0.14, well above the legal limit of .08.

Leyritz pleaded not guilty to two DUI manslaughter charges and was released on bond pending trial. One of the conditions: No alcohol.

Bogenschutz said Leyritz registered more than 4,000 clean alcohol tests over the last year, but that confusion arose when his case was no longer supervised by Pre-Trial Services. At that point, in April 2008, Leyritz didn't realize the no-alcohol provision still applied, Bogenschutz said Friday.

Also at that time, Leyritz switched from a portable testing device to the Interlock device in his car, according to Bogenschutz.

Bogenschutz said the Interlock device registered trace amounts of alcohol twice in September and once in November.

The most recent positive test came on Jan. 9. Bogenschutz said the monitor registered a blood alcohol reading of .05, below the legal limit, while Leyritz was driving.

The device forced Leyritz to pull over and wait an hour, Bogenschutz said.

Bogenschutz wouldn’t say if Leyritz admitted drinking again or if they would dispute the accuracy of the monitor. He said all four positive tests came in the morning.

Bogenschutz said the January reading triggered a report from the monitoring company to assistant state attorney Stefanie Newman. Newman filed a motion earlier this week to revoke Leyritz’s bond.

“Stefanie had no idea Pre-Trial Services was no longer supervising Jim,” Bogeschutz said.

According to a November 2008 report in the New York Post, Leyritz asked to have the monitoring device removed from his car, calling it “bothersome.”

According to the Post report, Leyritz’s attorneys complained in court documents that it made life difficult because his car couldn’t be started by valet parking attendants. And his ex-wife said he “can’t eat things like chicken Marsala,” because certain foods caused false positives.

We’ll see how Judge Gold reacts to the latest. He could issue Leyritz another bond with stricter conditions such as home confinement, or he could make Leyritz sit in jail until trial.

One thing seems certain -- in the court of public opinion, Leyritz has struck out.

How fucking dumb is this guy? He wasn't supposed to be drinking at all. I can understand how an alcoholic would have a hard time quitting...but getting behind of the wheel with alcohol in your system while awaiting trial on a DUI manslaughter charge? What an idiot.

He is 9 years removed from being a Yankee. His actions now have absolutely nothing to do with his wearing Pinstripes. Should we start talking about former Mets off-field behaviors as well? The names Strawberry and Dykstra come to mind pretty quickly.

I know that. But it's true that I'm sure it's not easy to quit drinking if he is a hard core alcoholic, but I can't believe he was caught driving. It turns out it was in the morning...so he was probably so shitfaced the night before that he still had .05% in his system the next day. :bottle:

I was actually arrested in Reno for drunk and disorderly conduct about 10 years ago. I was held for 8 hours and then was supposed to be released. But before they let you go, they give you a breathalizer to make sure you're sober after the 8 hours...I actually still blew a 1.4%. They had to keep me an additional 10 hours or somehting like that. :jj:

Oh my god, that mother fucker won't see daylight for a long time. Not only will get his ass thrown in jail, but when he gets sentenced, he won't get credit for time served. I hope somebody kills him in prison.
