CBS really fucked themselves with this lawsuit. Sirius gets 20 years of Stern tapes for $2 million. They also suggest that there will be a classics channel:


Sirius 8K Release - 2 Million the Only Payment to CBS
May 30th, 2006

Sirius had announced that the 20 year catalog of Howard Stern materials will be available to them for the Howard Stern channels through the duration of his contract with Sirius. However, their 8-K, released today, states that this 2 million dollars is the ONLY payment under the settlement agreement that they will be paying out.

Whether Stern did or did not have to pay out anything himself is unknown due to a seal on the settlement agreement.

From Sirius's 8-K:

Section 8.01 - Other Events.

The lawsuit brought by CBS Radio Inc. against us along with Howard Stern and others referenced in Item 3 of our 2005 Annual Report on Form 10-K has been settled. As part of the settlement, CBS Radio is conveying its rights in the recordings of the Howard Stern Show that aired on CBS Radio from 1985 through 2005. We will have the right to use those recordings as part of our Howard Stern channels through December 2010. We are making a total payment of $2 million to CBS Radio. This is the only payment we will make under the settlement agreement.

No fucking shit!!! Can you imagine how cool that will be??? 5 days/week of shows unheard for a decade or more. They should just start at day 1 and play them all the way through.

The question is, what happens after 2010? Do they revert back to CBS, or Howard? If Howard re-signs, do they get to play them until 2015?

Guess we'll find out in December 2010.

In another statement it was said that the archived KROCK shows are "unedited".

From what I gathered, they have the rights through Howard's contract suggesting that they're going to be his.

They belong to Howard and Sirius:

I would expect that whatever deal they cut, Howard was gonna make sure they couldn't play his material after he left, unless he gave them permission to do so. I wouldn't be at all surprised if he has exclusive rights to his Sirius and OnDemand recordings, just like he did with E!, since both Sirius and OnDemand weren't coming into negotiations with him in a position of power.

Unless Howard is also paying, 2 mil seems like an awfully small amount for CBS to completely sign away their rights to the tapes. Either they truely got shafted in the settlement, or CBS is only "leasing" the rights for 4.5 years.

Or, CBS realized they were going to lose both the initial case and likely the counter suit and figured they needed to cut and run. Including lawyer fees for a multi-year trial, they stood to lose a LOT.

He had said the K-Rock tapes were to play a part in his plan on Sirius, for the audience to be able to hear things that they haven't been able to play in "Best of" over the past 5 years but were able to in the 90s, not just the bleeped material, but the stuff Tom didn't allow for replay.

I wonder with all the stuff going on at K-Rock if Tom's starting to clean his desk out. Not sure if Stern would hire him, but there are times when they ganged up on him and Fred's robotic impression that I miss.

Was cool hearing Crackhead Bob again.

Hopefully Jackie can wind up on Sirius, maybe not part of Stern all the time (once in a while would be great) but at least on 101 for an hour or 2.

Whatever the exact deal it is great news not just for the fans but for Sirius stock holders. Lawsuit settled, more value for the buck to come on board. A couple decades of content isn't a bad thing for someone to have and now all the longterm fans will be able to stream the classic shows along with the new ones. It is also incentive for Stern to stay on board in some role or another beyond the five years.

The only bad news? It means that the televisions I am already ignorning in my home in favor of Stern are going to be further neglected.

I saw several people on XM boards suggesting they'd get Sirius just to hear all the old shows. I'm waiting to see what this does to the stock today.

$2 mil for nearly 20 years of material

I'm sure this has been answered here somewhere but will the KROCK tapes be 100% unedited?

I have a load of KROCK shows but the sound quality is shit, i can't wait to hear them with full quality sound.

How about all of SFN get together and push the idea of Howard and Sirius to put out "Best Of CD's" if it is possible under the new deal... how great would it be to have the "BEST OF CRACKHEAD BOB" or "BEST OF THE JACKIE PUPPET", OR "BEST OF TED KENNEDY IMPRESSIONS" on CD to take with you wherever you roam!!! Come on Howard it's not selling out it's giving the fans what they want and making even more money in the process... Win, WIN!!!

That was one of the first things I thought about when I heard he got his tapes back. I know Howard hates to sell crap like that, but it could make a LOT of money for Sirius at a time when they could really use it.

I am so happy for Howard and the rest of the gang. I doubt that he will have the same problem with Sirius in the future, once bitten, twice shy. All I know is that Canada's Sirius better offer us the station they might have to air the old shows.

$2 million for 20 yrs of shows? Assume 220 shows/yr and 4 hours per show (of actual content less ads) and that works out to $114 per hour. What a deal especially whan you consider the $500 million Sirius contract works out to nearly $100,000 per hour. Bring on Channel 102.

I am sure Howard made out in this deal, but we may never know it because of the gag order. CBS realized they were over their heads with this suit.
