This all happened in April, but I wanted to share this experience so you can make sure it doesn't happen to you. This is an e-mail that I sent to the BBB.

It all started last Monday when I was balancing my checkbook & I forgot to deduct Sirius' charge from my account & I got an overdraft fee. So I got tired of getting overdraft fees because I'm a Sirius subscriber on a month to month basis. So I wanted to stop getting these monthly charges so I deecided to pay for Sirius on a yearly basis & to get a yearly invoice.
So last Monday I called Sirius, I spoke to a customer service representative who spoke such broken English that I could barely undersatnd him unless I really concentrated on what he was saying. I told him that I wanted Sirius to stop taking money out of my bank account on a monthly basis & I wanted an invoice to be mailed to me on a yearly basis & for Sirius to stop taking money out of my account. He understood & told me that my credit card information that was on file would be deleted. I understood this & beileved it when I hung up the phone on Monday.
Wednesday I logged into my online bank account & what I saw almost floored me. $302.00 of the $380.00 that I make on a weekly basis, was taken out of my bank account by Sirius radio. I was fuming mad because I had written checks that this $302 was supposed to cover & my girlfriends birthday was the next day, Thursday, PLUS I needed thet money for my Diabetes medication. Without that money my bills couldn't be paid, I couldn't take my girlfriend out to dinner & buy her something, & I couldn't buy my medication. I called up Siruis again on Wednesday & spoke to another customer service representative who's broken English wasn't nearly as bad as the person that I spoke to on Monday, but it was still bad. I asked why $302 was taken out of my bank account. Apparently for some reason I was charged that money because somehow a 2 year subscription was charged to my Sirius account & that's why the money was taken from my bank account. The woman told me that I would be refunded the money & I would get it in 48 to 72 hours. I said NO. That wasn't good enought & I needed that money NOW! She put me on hold & spoke to someone. She came back & said the money would be back in my account in 24 hours, this was 10:30 on Wednesday morning. I specifically asked the customer service rep that I would have my money back by 10:30 am Thursday morning & she said YES. I wasn't happy with it, but I accepted it because I thought I would have that money by the time I was to take my girlfriend out to dinner.
Thursday morning 10:30 rolls around & still no money has been refunded to my checking account so I call Sirius customer service again & as soon as a customer service rep picked up I told that person that I needed to speak to a customer service manager now. The person refused until I told him my story. SO I told him my story & I was immediately transferred to a customer service manager whose name is *****, I beileve his extension is ****. I spoke to him & I said I was so fed up that I was ready to rip the Sirius radio from my car and be done with Sirius & he apologized & he said that my money was transferred out of Sirius' account & the money was transferred to my bank on Wednesday & that it was in my banks hands & that the money should be in my banks warehouse waiting to be input into my bank account. He continued to apologize & said that I would get a free month of Siruis radio. Which all turned out to be lies.....again.
Friday morning still no money in my account so I called my bank & told them that I would be getting a refund & I asked if my money was to be entered into my account that day or what was going on. The customer service rep for my bank told me that there were no records & there was nothing in the warehouse that was waiting to be input into my checking account. So right after I hang up with my bank, I called Sirius customer service again. I spoke to someone who still again said that the transfer of $302 was made & that I should get the money soon & I told the person that I didn't want to be hit with an overdraft fee because of the bills that I already paid where there was no money in my account because of Sirius radios screw up. She told me that Sirius would pay for any overdraft fee. I was sill mad but a little calmer. Of course they never paid for any overdraft fees.
Saturday morning I woke up, checked my bank account & only $155.55 was put back into my account. So yet again I called the Sirius customer service department. I spoke to someone who told me that I was to get a refund of $310, but for some reason that he couldn't understand only $155.55 was allowed to go through to my bank. So all week Siruis customer service had been lying to me. The customer service rep was confused as to why only $155.55 was allowed to be transferred into my account. I was confused & pissed as well. So he said I would get the rest of my money & that it would take up to 4 days.
So I wait a couple of days to see what's been going on with my bank account because I'm afraid to see what happened next. So on Tuesday I check my bank account, I get paid every Tuesday, & instead of the $302 being refunded into my account, Sirius took another $302 out of my account. I was ready to drive to New York & choke somebody right about now. So I called Sirius customer service again & I tried as calmly as I could to find out what was going on/ It turns out that some idiot had mistakenly took $302 out of my account instead of putting it back in, but that it was corrected as soon as it happened & my online bank accound didn't refect the transaction. My question was if they can reverse that so fast, why couldn't they send the money back that fast to me in the first place???

I really hope that Howard does retire when his 5 years are up. I really don't want to have to go through this with these clowns every year. |

Everyone knows how a refund works on a credit card.
Sirius was wrong to say 24 hours.
They do the refund right away but it would suaully take up to 3 days to show up in your bank account or as credit on the card.
I mean as a RECENT example. I went to Sears and returned items on Monday. The refund showed up on Friday. I didn't care.
WHY?

| This exact same thing happened with me and DshNetwork. It is HIGHLY ILLEGAL, no joke. If you can prove that you never gave them consent to deduct the money from your account for the two years, you can sue them in small claims court for any overdraft fees you incure as a direct association from this. You can also ask for "damages" but you won't get anything from them on that. But they are liable. |

Dude this is standard business, it takes at least 3 business days to get a refund to go back into a checking account. Thats why you need a credit card, then it would not have mattered.
This has nothing to do with Sirius and is between you and your bank! |

Never ever agree to automatic billing.
Have them send you a bill and pay it.

| I have never liked Sirius' customer service very much. Last time I called a guy with broken english was pretty much yelling at me because I asked a question he must have felt was stupid :( |
