Anti-Satellite Legislation Returns

Anti-satellite legislation, a perennial favorite of the lobbyists at the NAB, has returned to Capitol Hill like clockwork. Every year about this time, lawmakers, nudged and funded by broadcasters, introduce what on Monday (Feb. 12) was billed as the "Local Emergency Radio Service Preservation Act of 2007."
The legislation seeks to hold satellite radio companies Sirius and XM to their “national-only licenses” while declaring local radio broadcast stations "an important source of local news and weather programming."
The congressmen behind the bill are the same as in the past three introductions: Rep. Gene Green (D-Texas) and Chip Pickering (R-MS). The latest incarnation is H.R. 983 and it “prohibits satellite radio licensees from providing locally differentiated programming to subscribers in one geographic market that differs from programming offered to subscribers in another geographic market,” according to the NAB.
Much like the previous bills, this version seeks to reinforce the same anticompetitive protections that would ensure terrestrial radio a leg up in local broadcasts. “Because radio programming is supported by advertising, the ability of local stations to continue to provide local news and other services and to ensure communications during emergencies could be jeopardized by a diversion of the listening audience away from local radio programming,” notes the proposed legislation. “When the [FCC] authorized the [satellite] service, it stated that it remained ‘committed to supporting a vibrant and vital terrestrial radio service for the public.’’’
Broadcasters have long feared that satcasters would use their significant terrestrial signal repeater networks to deliver local programming – and zoned advertising – further diluting the local advertising market by offering more choice.
Terrestrial broadcasters’ fear in that arena increased dramatically two years ago when both Sirius and XM introduced a series of new channels that offer local traffic and weather. Because of NAB’s significant lobbying efforts on the Hill and at the FCC, satcasters have been forced to offer the services on a national bases, so that listeners in the Baltimore and Washington market can just as easily hear about traffic in Los Angeles and San Diego as subscribers in Chicagoland can escape to Miami-Atlanta traffic and weather.
All previous attempts to pass this legislation have failed. As of October 2006, 138 representatives had co-sponsored a similar bill in the House and only four Senators had gotten behind a Senate companion bill offered by Sen. Olympia Snow. |

NAB Again Complains About Satellite Interference

NAB President/CEO David Rehr is again complaining to the FCC about satellite radio interference with FM transmissions. Rehr first complained to the FCC and to satcasters Sirius Satellite Radio and XM Satellite Radio last year, when reports surfaced that some of satellite radio's earliest devices were not in compliance with FCC regulations and allowed non-subscribers tuned to FM stations at the far left of the FM dial to receive satellite signals.
Satcasters use that portion of the FM dial to relay their signals to subscribers, but sometimes the channels overpower the terrestrial broadcast signals assigned to those frequencies. The FCC discovered the problem during equipment tests last year and took steps with the satellite companies to eliminate the problem in future satellite receivers. However, the commission did not recall any of the earlier devices that might cause the problem.
In a two-page letter sent Monday (Feb. 12), Rehr wrote, "Given Sirius' and XM's recalcitrance, it is left to the commission to take corrective action. Therefore, NAB repeats its request that the commission seek a recall of noncompliant satellite radio devices to prevent further disruption of listeners' access to free over-the-air radio." The latest letter was inspired by a recent article in the New York Times detailing the interference problem.
Friday Rehr addressed the Radio Advertising Bureau convention in Dallas and told attendees that the NAB intended to approach Congress and ask it to force satellite carriers to operate within the parameters of their licenses and be national services offering no local programming. |

From what I understand the hd channels are broadcast between terrestrial fm channels. Phx has 30 terrestrial channels with hd in between? Cummon. I have to admit if I get the hard wire shit problem solved.
