NICE!! Wal Mart has finally been shamed into doing the right thing!! Maybe it was Olbermann hammering them night after night.
Wal-Mart Drops Reimbursement Claim Against Injured Ex-Worker
April 01, 2008: 05:03 PM EST
BENTONVILLE, Ark. (AP)--Wal-Mart Stores Inc. (WMT) is dropping a controversial effort to collect more than $400,000 in health-care reimbursement from a former employee who suffered brain damage in a traffic accident.
The world's largest retailer said in a letter to the family of Deborah Shank it will not seek to collect money the Shanks won in an injury lawsuit against a trucking company for the accident.
Wal-Mart's top executive for human resources, Pat Curran, wrote that Shank's extraordinary situation had made the company re-examine the situation.
Deborah's husband Jim Shank welcomed the news. His lawyer said Wal-Mart deserves credit for doing the right thing.
Wal-Mart has been roundly criticized in newspaper editorials, on cable news shows and by union foes for its claim to the funds, which it made in a lawsuit upheld by a federal appeals court. |

The Bush administration has been receptive to Iran joining the WTO since 2005. Cuba is already a member of the WTO.
President Kennedy began the embargo on Cuba. Clinton tightened them as President. Many are receptive The ball is in Cuba's court, start by releasing political prisoners. |

First off I am no liberal. A quick read of my posts regarding the current pres candidates would make it obvious that I am open minded.
Second, I do not have the time to educate you on economics, global trade or ethical business practices. You'll have to get that education all by yourself. I am not confident that you will though as you seem to be very close minded. |

They were shamed into doing the WRONG thing. Geez, I fucking hate this pussy PC faggie country the USA has become. There is absolutely ZERO personal responsibility left. Someone signs up for medical insurance. They gladly collect the money to pay their medical bills. Then they double dip by suing to get paid AGAIN for their medical bills. The insurance company that this lady signed a legal agreement with, rightfully goes after the money that is theirs. And they are the bad guys and have to give up their claim to the money that they already paid out. This is like the idiots that bought houses they couldn't afford and now its the banks fault that these assholes can't pay their bills. |

the family didnt sue Wal-Mart, they sued the company whose semi-truck smashed into her. I dont know if you realize this about health insurance, but it doesn't pay for everything. Having a debilitating brain injury that needs constant treatment can get rather expensive, even with insurance. They sued to help pay the bills they already had...Wal-Mart then decided to sue her for everything they paid for, even though they promised to pay for it by giving her insurance. If it is personal responsibility you are longing for, than Wal-Mart has the responsibility to provide the health insurance they promised. |

Have you ever read any insurance policy that is currently insuring you?
This is how it works. You pay company A to insure you. To do this, you must sign papers that explain this legal relationship that you and company A are entering into. Part of that relationship is that if company A ever pays out on your insurance policy, THEY (not you) have the right to get back the money that THEY (not you) paid out by suing however cause them to have to pay on your policy. If you deny them the chance to sue to get back the money they paid out, then they have the right to sue you for that money. You don't get to have insurance pay out for your damages and then get to turn around and sue to get money for the damages that your insurance already paid out for.
To try to make it more simple:
Person B buys an insurance policy from company A.
Dickface C crashes into Person B.
Person B goes to the hospital and company A pay the hospital for all of the medical care that Person B needed (or the medical care that the insurance policy states they will pay for).
Company A now wants to sue Dickface C because his actions caused them to have to pay money out on Person B's insurance policy.
Before Company A can sue Dickface C for the money that they paid out, Person B sues Dickface C and wins a settlement.
Company A goes forward with their lawsuit against Dickface C but lose the case because Dickface C already paid out for the accident directly to Person B.
Company A now has to go after Person B because they violated the legal agreement they signed with Company A and have now got the benefits of the insurance policy AND got money for the same damages Company A already paid out for.
This isn't Company A being evil or wrong because Person B has a great sob story. This is Company A trying to get the money that is legally theirs. The money that Person B all along agreed would be Company A's money.
This is Person B getting a free pass for breaking the agreement they made with Company A because company A has a legion of sheeple that call them evil and again, Person B has a great sob story. |
