Just wanted to address some of the questions about Cindy Lauper and Alanis Morrisette's recent appearances. Unlike most artists, Cindy Lauper and Carly Simon control their own publishing rights so they were able to quickly and easily give us permission to air their performances. Look for Carly's rendition of "You're So Vain" on Howard TV starting tomorrow night.

| So if it is free you'll run it but if you have to shell out licensing fees you won't.....great. The customers get to cough up the dough but you guys don't have to. And some people wonder why we are so critical of HTV. |

In their position, I don't know that I would layout $40-60K for a single tune, let alone multiples of that for a "Stump the Booey" segment with 8 or 10 songs. |

Explain to me how HTV is different than the E! show for licensing and publishing. There was a ton of music on E! and they were notorious for being cheap.
Plus, every TV show on the air has a ton of music included with it these days. My understanding is that the fees are expensive for home video not for broadcast. Recently, they've started negotiating to get better deals, to include home video. Older product are still dealing with having to make changes or deletions.
Where does HTV fit in to the law? It's not exactly television broadcast but it's also not home video. However, you can watch it whenever you want and multiple times. Does this affect the fees?
I've seen other radio shows broadcast on cable tv live and rerun with multiple instances of copyrighted music being used throughout with no problems. Either they're paying a blanket fee or nothing. Can't you pay a blanket fee for HTV for the year that covers all the music? I'm pretty sure that's what's done for the radio side of it. |

i think tv is different from on-demand subscription type pay service
look at all the music that goes out on letterman leno conan etc., not only the music acts but in and out of commercials as well
regular tv must have a great deal worked out with the music industry |

We can't speak for what other broadcasters do but we air every performance we can get the rights to. The E! show worked the same way as HTV does. In the 12 years of E! shows we only ran a handful of music performances. |

You absolutely have to be kidding me. Do you seriously want to start a challenge with me on the number of music performances that E! had over the years as being closer to a ton than a handful?
I've only checked a half dozen of my tapes so far and already found 6 live tracks and 4 CD tracks played. I should have a complete list in a week or so. |

This isn't home video, it's television. From HTV themselves, they should be abiding by the same rules as the old E! show which ran many music performances (which I'm currently going through - a list will be posted here as a new thread soon). |

THERE IS NO REASON FOR HOWARD TV TO NOT SPEND THE MONEY FOR RIGHTS TO THE MUSICAL PERFORMANCES!
