in all seriousness, I hope this is the end of endless "one company or two" jabs for Howard. the country as a whole isn't in the greatest shape and a multi-millionaire bitching about being owed more millions doesn't win you any favor with your fans.

I don't know enough about the issue to really pass judgment, but if I understand the legal phrase"with prejudice", Howard will have a tougher time continuing the fight.

After reading the details of this suit, I am not surprised it was dismissed. Howie never talks about the $25 million he received when Sirius and XM merged. I am sure Howie is livid about this...poor Howie.

This IS great news INDEED but does any other news sources have this? What website is this exactly, looks like an official SIRIUSXM one? It's like the only thing I can see diverting all the AGT tedium. It's also funny how Howard's reported AGT salary is almost exactly what those bonus's would have been. Ahhh the Jews and all the $$$karma.

It's really a lose lose for the fans but the initial bratty rants will be some sort of pacifier at least. If he WON the lawsuit he'd be more complacently Hamptons Howie than ever. The richer he gets the less effort into radio. BUT in this case the bitterness of losing will make him more spiteful than ever towards Sirius and moreover the fans!

Why is this story not anywhere else? Even if you google news Howard, nobody else has this story up.

With prejudice, does that mean Howie has to pick up the legal fees for sirius??

Court Dismisses Stern Suit With Prejudice

The news will certainly send shock waves through the media as Howard stern has just lost his epic battle with Sirius XM Satellite Radio (NASDAQ:SIRI). The suit, filed over a year ago, had some tantalizing tid-bits of the history of the Howard Stern deal with Sirius, the merger with XM, and of course the massive bonus structure that Stern received as part of the deal. Stern, has had many rants on his show about how he feels the company cheated him out of potential bonuses worth well over $100 million and possibly as much as $300 million.

The sides have been at odds for months, but in the end Sirius XM’s request for summary judgement came down in the favor of the satellite radio provider. Documents filed in court today confirm Judge Barbara Kapnick’s ruling. Stern and his agent, Don Buchwald, have the right to appeal, but as of right now Sirius XM is victorious.

The biggest factor working against the Stern side was very specific bonuses paid out in the event of a merger with XM. It would appear that the court felt that the language in this section created a separation in the subscriber pool, and that a value was placed on the XM side of the equation in the event of a merger. Stern received that payment and thus in the thoughts of Sirius XM, they had already made him whole.

Stern may well have some choice words about the decision, and it could make for some entertaining radio. Stay tuned.

I can't find anything either and my Spidey-sense was tingling because (s)tern wasn't capitalized in the first sentence.

Since Howie doesn't give a damn about the show now, can you image how much worse the show will be now that he lost the lawsuit. Two days a week may be the norm and his effort will be subpar. Howie will just play out his contract and drive subscribers away to hurt Sirus. It's ashame for us the fans and for good entertainment in general.

Howard repeatedly said that a judge could read it and quickly decide the suit's merit.
Apparently he was correct.
