breaking news: howard looses lawsuit with prejudice

    With prejudice means that it cannot be re-filed. Without prejudice means that plaintiff can re-file. Although I didn't see that in the ruling, the blurb posted by Onehourphoto states that the decision can be appealed.

    Howard didn't just pull a number out of his ass and decide to sue for $300 million. That was the compensation agreement that was agreed to when he signed. He felt he met the terms, Sirius did not.


    If it is in fact true that the decision can be appealed, which is true of most court decisions, then expect that it will be. I'm no lawyer, but there is some language in the decision that I would expect to be attacked in an appeal. A successful appeal would not mean that Howard wins the suit. Sirius requested summary judgment dismissing the suit, plaintiff was saying, no, we need to take it to trial.


    The most interesting thing I get out of reading the decision though, is the feeling that Sirius XM kept the two services separate specifically to avoid paying the bonus. The argument that Sirius subscribers and XM subscribers are different is pretty weak if they are accessing the same service. Not that anyone should blame them - they obviously don't want to pay any more money than they have to.

    By the same token, I don't blame Howard for trying to get every penny he thinks might be owed to him. I would do the same, and I bet everyone here would as well.

    find it hard to believe Howard wouldn't have been at court for this though. I suppose it could have been after the show.

    1 more thing to worry me that this is howard's last contract.

    If it can be appealed, I expect it will be. Why? The same reason all court decisions are appealed. Because the side that lost has another chance to win, and most people would rather win than lose. Pretty basic stuff, really.

    There probably wasn't even a court session. The judge made a ruling in regards to Sirius motion to dismiss.

    You do know that ALL lawsuits aren't appealed right? Especially ones that reject your claim. There are large expenses for an appeal. Why would you risk so much money when you now know there's a small chance you will succeed? Do you think there's any particular reason you're not an attorney?
