    Don't know nothin bout no Carl Rove, but if you read some of less publicized details of that case, it certainly doesn't seem so frivolous anymore. Starting with the fact that she initially sought $20,000, after spending 8 days in hospital getting skin grafts for third degree burns. McDonald's refused.

    Buchwald and Howard's lawyers could have fixed some of that.

    There is even mention of what-if discussions regarding a future merger scenario prior to 2006.
    I don't have an answer to the ambiguity. They weren't shmatt.

    Judgement read that Stern does not have to pay lawyer fees for Sirius. Nobody gets anything. It is dismissed and can not be refiled.

    Looks like Howard was played by Sirius as they were laughing when he signed this contract. They knew he would never collect a penny from a xm subscriber beyond what they agreed to.

    This has to fall on the hands of Don Buckwald. He did not have the contract worded right to protect his client. Howard never mentioned the clause of him getting paid seperately when the merger went thru.

    so just to play devil's advocate, how many is he responsible for losing? let's face facts, he has no where near what he had during his terrestrial days and he has only a fraction of those that initially signed up in '06. they said that at one point the numbers started to rise with new car sales (i'd imagine a lot of them included a certain amount of months subscription.) with the tough times how many people are still around from that initial year? if it was a great amount Howard would be screaming about that from the mountain tops...but he's been rather quiet about that. also remember the surveys that were sent out last year?

    Only people firmly in Stern's camp are surprised by this. It was an unethical cash grab by Stern and Co. Who tried to find a little ambiguity in the contract that went against both the spirit and the clearly written portions of the contract. Those wearing Stern Colored glasses clearly were delusional in thinking Stern would win this. Some partner you are Howard.

    Howard really thought the company was going to give him 100-300 million on too of his 509 mil plus the 25 mil bonus he received? Man he really did want to bleed them dry.

    Doesnt matter how many people hung around. Bottom line is Howard payed for himself at the end of the day, I do not think anybody is doubting that. Oprah has not payed for herself. Not even close. Let Oprah go and promote, so she can sleep at night that she at least tried to help the company be succesful. Howard has pulled his share.

    I disagree. I can understand where Howard can say, you know what, lets take a shot. Alot of this language can go either way and lets let a judge decide. In the scheme of things for Howard, this was a low risk, high reward type move. If he loses, it costs him lawyers fees, pennies to stern.

    and in the current contract tells me that maybe he isn't in Sirius/XM's eyes? cut budgets, having to do his own repairs, staff used on other shows, etc? I don't know all the fine points like you may King, but I just think that Mel is in a tizzy about what Howard has been churning out and his efforts. he'll never publicly state that because he and Howard have a very long and successful careers because of each other. but some of the company actions speak otherwise.

    I think what we have learned from this is that Sirius and XM are 2 different companies and the Best of Sirius/Best of XM packages will not be going away.

    I only know what I read in these court documents. Nothing more.

    I think Mel disagrees with Howard, but all in all, they have been in a very succesful relationship. There is no doubt that Howard has been a excellent investment business wise, regardless of how many days he is on.

    There are always 2 sides of a story, then the truth somewhere in the middle. I imagine that is the case. Same way that if you only listened to howards take on the court case, but then read the actual court documents, you would be shocked of what the truth was according to the judgement.
