    No, judicial activism is creating "rights" out of thin air. For example, the California court that threw out the vote against homosexual marriage on the basis that "civil rights" were being violated is a clear case of judicial activism - nowhere in the Constitution does it say that people have a right to marry.

    What is at issue in this case is quite clear - the court is being asked to determine if the Federal government has a Constitutional right to force the people to enter into a private contract or to purchase something in the free market.

    I hate the fucker who occupies the white house, but I've read the constitution and agree with the Kenyan there is no power for judicial review of the federal congress. Marbury v Madison was a sham 200 years ago and it still is. I'll side with the greatest American, Jefferson, and his Kentucky resolution outlining nullification by the states. I'll take the high ground and do this consistently not only when it suits me like the Kenyan.

    Except Barry is lying. It will NOT be unprecedented because the Supreme Court has been overturning shitty legislation for about 200 years. As you pointed out, Barry taught constitutional law and knows this, yet he lied and said it's never happened before.

    do you have the right to not buy health insurance or can the government force you to buy it?

    if the government has that right, what other products can the government make you purchase?

    how about people rich enough to self-insure themselves, are we forcing them to buy it also?
