No, judicial activism is creating "rights" out of thin air. For example, the California court that threw out the vote against homosexual marriage on the basis that "civil rights" were being violated is a clear case of judicial activism - nowhere in the Constitution does it say that people have a right to marry.

What is at issue in this case is quite clear - the court is being asked to determine if the Federal government has a Constitutional right to force the people to enter into a private contract or to purchase something in the free market.

Marbury v Madison was a sham 200 years ago and it still is. I'll side with the greatest American, Jefferson, and his Kentucky resolution outlining nullification by the states.
