    Howard Stern sidekick Joey Boots hit with summons for photographing National Guard at Penn Station


    A Howard Stern regular who photographed National Guardsman on duty at Penn Station now has a date in court.

    MTA cops slapped him with a criminal summons Wednesday for interfering with traffic.

    Joseph Bassolino-known as Joey Boots-likes to jump in front of TV reporters doing live street broadcasts and yell "Bababooey!"

    In this case, he said he was perfectly within his legal rights to photograph the soldiers near the LIRR entrance on Seventh Ave.

    "I was keeping my distance to not interfere," said Bassolino, who goes around the city photographing and documenting "all the interesting things I see about the city."

    MTA spokesman Salvatore Arena said photography is allowed in the station, "but you are not allowed to pursue your subject in an harassing manner."

    "However, based on a video posted on YouTube, we will be looking into the conduct of the police officers," he said.

    Bassolino, 44, who said he's on 100% service-related disability, claimed "thousands of followers" at his on-line website joeyboots.com.

    "I felt that this was an interesting thing to photograph - the fact that we have armed soldiers with M16s on the sidewalks of New York City."

    Bassolino said when the soldiers turned their backs on him, he walked around to the front and kept clicking away.

    "A soldier approached me and said 'You can't photograph us.' I turned on my videocam and he walked away."

    A short time later, he said MTA cops approached him - "one called me a creep" - and charged me with interfering with traffic."

    He said he initially videotaped the cops before he was ordered to put the pocket video camera away.

    Bassolino said he now has an Aug. 3 date court date.

    Listening to this guy argue law is disgusting. There can be an expectation of privacy in public and the #1 rule is that if you argue with a cop you get fined. There are anti-recording laws that say that you can't audio record someone if they won't consent. Although these cops were clearly dicks. Also what's interesting about increased law enforcement at a mass transit center when the evidence recorded at Bin Laden's compound said that was the next target. Great time to mess around with law enforcement.

Boots did nothing wrong. As an Italian I offended at the cop calling Joey a disgraceful Italian because he didn't do exactly what he told him to do and questioned his authority. You guys bashing Boots for this ones are exactly what you claim he is. Douchebags.

    Ok, yes the cops were being a bit dickey, but it's stupid, aggravating, and unnecessary shit like this that they should not have to deal with. If one of out soldiers requests that you not follow or film him, you don't do it and the cops have every right to step in, he's lucky that they did not handcuff and arrest him. Sure Boots is holding a camera, but how do our military guys or cops know that it's not some sort of makeshift gun or other weapon. It's distractions like this that our great military men and women don't need, they are risking there lives to make sure that we are kept safe and they do not need to be preoccupied by some dick with a camera who won't leave them alone. You want to film, take pictures of them, ask. If they say no or ask that you not film or point an object at them be respectful. The cops should have spoke to that wise ass like they did, look at the face that fat bastard always has on, he looks like he's smelling something bad and he is as big as a house and talks like an uneducated, freeloading wiseass. Oh and he can work, he had driven a cab and worked as a chauffer. I hope Howard reprimands and bans him for being a thorn in the side of our military and law enforcement, and I hope the judge throws whatever book at him that he/she can, and they find further charges to hit him with based on this video. Had he put the camera down and stopped recording when he was asked and shut his fat trap, he would not have gotten a ticket. What a douchebag, I hope the section of the military who handles his pension gets a hold of this and cuts his bullshit benefits. I call treason and espianoge !!

    Joey Boots is just being a pain in the ass. He doesn't give a shit about the pictures, he just wanted a reaction from the soldier or cops.
    He got what he was looking for and now he can cry that his rights were violated.
    Not only that, he causes taxpayers to shell out more money for this idiot when the courts have to deal with him.

    Stop making sense, man. Do as your told and accept what the government tells you. You can be video taped on every corner and have your asshole fingered by the TSA, but catching a Guardsman on a handycam is unpatriotic and EVIL!!!
