Mindboggling that Howard doesnt understand why his lawsuit was thrown out in summary judgement?

    I just dont get why Howard thinks he should get credit for the XM subsribers that were already there before he got there? I understand if they grow another 20 million or how many ever it states in his contract to get the bonus! It drives me crazy that he is that greedy that he thinks he deserves credit for the other subsribers that had XM before he came aboard??

    Court basically said Howards suit is frivoulous. Wonder if he still believes that the losers in lawsuits should pay the other sides legal fees?

    It doesn't help that his money grab attorneys are in his ear prodding him that his understanding/interpretation of his contract is correct. tsk tsk

    I hope the Appeals Court overturns the decision. Not because of Howard or the money, but simply because this board will be thrown into total chaos and I can't wait to read it all.

    I kind of get what Howard is driving at - Sirius put a valuation of an additional 2 million subscribers in 2006 at $75 million, and a complete merger with XM at only $25 million. Doesn't really make sense. If I were a judge, I'd have to side with Howard, just looking at those 2 points. Having not read the contract, I have no idea if it stresses that new subscribers have to be directly attributable to Howard 100 and 101. If it doesn't, Howard does have a case, IMO.

    what baffles me is that Howard thinks that by doing a 2 or 3 shows a week, 6-10 AM he thinks he is screwing Sirius? earth to Howard, you are fucking over the people that got you your first bonus when the merger happened! and if that hurts your feelings, take another call from Mary Anne or Bobo and they can suckle your balls

    Howard does not like to lose. He doesn't take losing well.
    It is pretty clear to me why he lost, but howard figures if he keeps saying the judge was wrong, that it will be reversed.
    The judge made the decision WITH prejudice, so I don't know Howard can re-file. He will have to change the way he wants to sue.

    The lawyers are just milking him for his money and filling his head full of nonsense.

    He forced a merger that wouldn't have otherwise happened. Therefore he's responsible for all the new subscribers. What don't you get?! Are you proffesional or what?! OOOHH GOOD FOR YOU

    About a year or so ago, I recall some heated discussions here with various wanna-be attorneys about the fate of this frivolous lawsuit.

    Forced a merger? XM still had more subscribers when they merged and Sirius essentially paid for XM's subscribers. What if Sirius during the first year of Stern's contract would have borrowed the money and done a leveraged buyout of XM, would Stern still deserve his bonus based on the written terms of the contract? What if Sirius still had the 600,000 subscribers when they merged and XM's 9 plus million were added to the total do you think Stern should get his bonus then too? The contract language was clear to the judge.

    What the funniest part of it all is listening to Howie talk about the Judge and how she is "wrong" in her decision. He obviously doesn't know what Summary Judgment is...I mean, the Judge took a look at the evidence and basically wiped her ass with it. She didn't even allow for discovery...that is pretty bad. Of course Howie's lawyers want him to keep fighting...more money for them. Its laughable, and people wonder why the courts are filled with bullshit cases like this.

    You are 1000000% right that Howard doesn't deserve credit for the XM subscribers.BUT IN THE CONTRACT THAT the idiots at Sirius/XM gave Howard,it mentioned nothing specific about the 2 different companies.All the contract said was if Sirius past a certain amount of subcribers then Howard would get the bonus.Those idiots didn't anticipate a merger.

    Unfortunatly for some of you guys there's an appeal process which Howard more than likely will win.Best bet is there will be a settlement.But this lawsuit is all Sirius.I totally blame this company for not putting the effort into putting on what people want.

    Man...Your angry and your wrong.But I'm guessing it isn't the first time.We'll just agree to disagree.You can believe that Sirius specifically put a clause in for a merger that Howard gets no money and I'll believe the truth..
