Overturning Obamacare would be Judicial Activism by the Supreme Court

    President Obama on Monday issued stern language to the Supreme Court of the United States regarding his health care law, expressing confidence "Obamacare" will not be overturned by the nation's highest court.
    "I'm confident this will be upheld because it should be upheld," the president said Monday afternoon at a White House press conference that included ‪Canadian Prime Minister Stephen Harper and Mexican President Felipe Calderon, who are attending the North American Leaders' Summit. The president said overturning the law would be "an unprecedented and extraordinary step" and compared the court's rejection of the law to "judicial activism."
    "For years what we've heard is the biggest problem on the bench was judicial activism," the president said, baiting conservatives who have long complained about justices' political agendas. The president stressed that the judges are "unelected" and noted that the law was passed by a democratically elected Congress.
    Monday's comments were the first public warning the president has issued since the justices heard oral arguments last week on the constitutionality of the law, which includes an individual health care mandate.
    It remains to be seen how the justices will rule on the matter. On Friday, the court began deliberations, which could last through June. The ruling could significantly impact the president's re-election strategy.

    He's already setting up his demagoguing of the Supreme Court when it goes down in flames... only the gullible don't see this.

    But those comments were certainly not coming from a man hoping to see the centerpiece of his 4 years in office go down the shit tubes...

    The Supreme Court has lost all credibility IMO. They could do anything and the US Constitution doesn't mean shit anymore to them.

    These fuckers have gone off the deep end. I think each Justice should be strip searched before they can sit on the bench at each session of the Supreme Court. Its just safer for them that way, a good way to cut down on injuries and diseases.

    The reality is that you have positions that are supposed to be impartial being filled by people who are partial. It is a farce and the constitutional professor in charge is another one with that type of comment.

    IF they say the mandate is unconstitutional then fine. But obama his calling them out in case they want to toss the WHOLE Affordable Health Care act. Which would be a whole different story.

    I think they will leave it alone and declare the act constitutional.

    I just don't see SCOTUS fucking over POTUS like this. Its not something they do or really have done in recent memory. It would certainly be a monumental act of judicial activism and I don't think they want that on their heads.

    Obama doesn't care to know better. As long as he's speechifying against some kind of bogeyman, he feels like he is on the side of the public, no matter how inane.

    Without the mandate the WHOLE act wouldn't have passed because it wouldn't have been scored deficit neutral by the CBO, even with the gamesmanship that went on there. So the WHOLE act unravels and can't be funded or feasible.

    The whole notion of judicial activism is rather absurd. Anytime a judge or court rules against a law it is activism. The whole point of litigating a law is exactly to decide if the law is valid. Some will be upheld and some will be overturned. Thus activism is really just a buzzword that in effect means nothing, except that you won't be happy when Obamacare is eliminated.

    Obama makes a valid point. This is big legislation and SCOTUS is usually not in the business of taking down big legislation and stepping on a POTUS's neck.

    They are too smart to strike it down.

    Funny thing. The pres used the Gonzales vs. Raich case for thier argument. Which was a war on drugs-commerce clause can be used even if you are growing your own pot for your own medical use case. I dont remember any outrage about govt overstepping in that one.

    Side note. Thomas dissented in that one!! Scalia did not!

    Obama makes no point at all other than to try and use his bully pulpit against an independent branch of the government.

    And from what cases I've taken note of, sparing the President's ego doesn't trump the Constitution when the Supreme Court decides these matters. Obama ranks saving his own neck far above protecting the rights of the citizens of this country.
