    Does he ultimately deserve more money? Probably not. He's been phoning it lately. But a contract is a contract.

    The XM people are the exact opposite of Stern recruits. In fact they chose the service that DID NOT have Howard Stern. Why should he get credit for customers he failed to woo over to SIRI??

    Yes, because Howard signing with Sirius basically helped put XM (who had previously been in the lead for sat. radio) down for the count.

    So, if I buy a Coke...and then Pepsi and Coke merge, should Pepsi executives get bonused for winning me over as customer? It seems to me XM customers chose to buy a competitive product. I don't see why Howard should get paid on these customers considering they specifically chose to purchase a competitive service.

    The pressure from Howard's rising subscriptions forced the merger so indirectly and directly he brought all the subscribers under one umbrella. Even with the power of Howard's obviously strong legal team the powers that be still own those court decisions and they're not willing to share.

    Good luck with a the appeal, you'll need it.

    Equal under the laws. New money need not apply.

    Yes, but he got paid on the "rising subscriptions" that forced (directly or indirectly) the merger. The way I see it, he was highly incentified to grow Sirius, which he did. Any byproduct of that growth is irrelevant. Suppose Sirius bought a non-satellite provider (ex. Netflix); should he be paid for those subscribers? From what I understand, most XM subscribers couldn't listen to Howard...why would he be paid for those folks?

    i bet he did but screwed us all of out of 3 channels 24 hour 7 days a week 365 day in a year of real live talent and all we get is 2 days a week of promoting the gayest talent show ever 2012 version of the gong show, and best of tapes from 1988

    He wants a subscriber bonus for bringing the 10 million from Xm to Sirius/XM, poor guy is beyond delusional about many things.

    The case was flawed from the beginning and motivated by pure greed and ego.

    Adding subscribers to Sirius would be by their choice not by a merger which was not their choice. It is a very thin notion but one that Howard could not take advantge of.

    Sirius caused the merger by hiring Howard which forced them out of business and brought them to Sirius. It would be different of all of XM's subscribers cancelled the service and got Sirius because of Howard.

    Howard outsmarted himself. I guess he's a dumbass like Conan how didn't get the 11:35 PM clause in his contract.

    i keep telling u this, so u have no fukn excuse after all these years: many (perhaps MOST) satellite subscribers had NO IDEA that "Satellite Radio" meant 2 different companies.

    at this point ur just willfully being a contrarian asshole, always trying to stick it to the White Man. :whistle:

    Twat Howard and his crack team of jewlawyers didn't count on was SiriusXM creating separate XM vs Sirius tiered-level subscription.

    The corporate merger left two separate entertainment packages for existing clients of either to chose from.

    Loophole maybe, but it proved something that team Stern hadn't anticipated could easily be proven.

    Those that didn't get the Stern show had the choice to make a call and sign up. If they didn't, then they weren't looking for it. Simple as that.

    If MOST subscribers didn't realize what they were signing on to, which itself sounds like a stretch - but ok, assuming it is true, once they realized 'hey, no Stern, wtf!!' they could make one phone-call and 'there he is'. It wasn't even a remote concern to most.


    Good decision that won't be over turned for legally sound reasons. It was a frivolous suit in the first place. A calculated gamble that cost a little respect and a few million in fees, but might have earned another third of a billion of his loyal fan's marbles.
