    This one is pretty black and white to me. People needn't be strip-searched before being held in jail for minor offenses.

    ITS UNREASONABLE.


    Right of search and seizure regulated

    The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no warrants shall issue, but upon probable cause, supported by oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.

    By that reasoning, we can deconstruct the entire constitution.

    Even the most chronic or hardened inmates have basic rights that are protected by the U.S. Constitution. If you are facing incarceration, you should know your rights.


      • Inmates have the right to be free, under the Eighth Amendment, from inhuman conditions because those conditions constitute "cruel and unusual" punishment.
    Inmates have the right to be free from sexual crimes, including sexual harassment.

    Inmates have the right to complain about prison conditions and voice their concerns about the treatment they receive. They also have a right of access to the courts to air these complaints.

    Disabled prisoners are entitled to assert their rights under the Americans with Disabilities Act to ensure that they are allowed access to prison programs or facilities that they are qualified and able to participate in.


      • Inmates are entitled to medical care and attention as needed to treat both short-term conditions and long-term illnesses. The medical care provided must be "adequate."

      • Inmates who need mental health care are entitled to receive that treatment in a manner that is appropriate under the circumstances. The treatment must also be "adequate."

      • Inmates retain only those First Amendment rights, such as freedom of speech, which are not inconsistent with their status as inmates and which are in keeping with the legitimate objectives of the penal corrections system, such as preservation of order, discipline, and security. In this regard, prison officials are entitled to open mail directed to inmates to ensure that it does not contain any illegal items or weapons, but may not censor portions of correspondence which they find merely inflammatory or rude.
    Inmates have the right to be free from racial segregation in prisons, except where necessary for preserving discipline and prison security.


      • Inmates do not have a reasonable expectation of privacy in their prison cells and are not protected from "shakedowns," or searches of their cells to look for weapons, drugs, or other contraband.

      • Inmates are entitled, under the Due Process Clause of the Constitution, to be free from unauthorized and intentional deprivation of their personal property by prison officials.

    Reasoning? Mark, the rules were set in 1972 when the Federal Government decided that every employer had to provide a safe work place according to the job task. If people were concerned how that may effect their freedom, they should have addressed it 1972. If there is a risk, there has to be a program that deals with it.

    Zimmie, if you are arrested and held in jail because of unpaid traffic tickets, DWI, or say unpaid child support are you still an inmate or are you in police custody and is their a difference?

    Excuse me, my employer does look in my colon before I go to work.

    We have a fundamental difference of opinion. I will never consider strip searching for any offense to be anything even remotely resembling "reasonable"

    in the unpaid ticket scenario, they issued a warrant for your arrest. Most people will just post a bond and will be given a court date and released...... otherwise they can hold you for so many hours before they have to charge you or let you go I would think your attitude, demeanor and cooperativeness gives them reason to consider how you're treated. If you're just in custody, you are generally at a police station, don't see it happening there. Cops don't have the personnel to be strip searching everyone. At a county or state facility some may do it to intimidate prisoners and show them who's in charge

    As long as you haven't been thoroughly cleared through whatever means, you're usually in police custody. They may have frisked you in the field, but they still have methods in place in case you houdini them. Once you're in custody you're usually in a place that will not allow firearms to be accessible to anyone. How they get you there is what the question is. When I go to do work inside any correctional facility they usually do a pretty complete rim job. Including family history to make sure there's no family reunions.

    in many cases they undress those arrested to determine what gang they're in...lets the correctional staff know who they're dealing with...

    Its still bullshit.

    Strip searching a citizen for a minor offense is unreasonable. Period. End of sentence.
